The following Terms and Conditions shall apply to all Users in relation to XPLORE provided Services through XPLORE Website. These Terms and Conditions come into force once You accept the Services through the Website or through any other form of communication with XPLORE.

XPLORE is not a travel or tour agency, nor is it a provider of tours or trips. We do not offer any Services ourselves. When You make a booking, You use the Website to contract with Third-Party Service Providers.
By using or accessing the Services, by booking a trip (“Booking”), and/or creating an account on the Website an (“XPLORE Account”), You agree to be bound by these Terms and Conditions without modification, and You represent that You have read and understand them.
When You make a Booking, the person making the Booking shall be deemed to have accepted these Terms and Conditions on behalf of all persons named in the Booking.
The User warrants and accepts that the use of the Website and the Services provided by XPLORE is the sole liability of the User, and further acknowledges that XPLORE disclaims all representations and warranties of any kind, whether expressed or implied.

The following definitions apply to the Terms and Conditions set out below.
“We”, “Us”, “Our”, “XPLORE”, “Website” and “Platform” shall refer to Xplore Online For Digital Marketing Co. XPLORE, its employees, and authorized agents.
“User(s)”, “You”, “Your”: shall refer to any independent people (whether an individual or entity) who visits, uses, accesses or benefits from the variety of Services offered on the Website.

Third-Party Service Providers (Service Providers): means the independent contractors and the entities that carry out or undertake to carry a particular service or perform any other service within the scope of the provided Services as herein stated which includes but are not limited to tour agencies.
Applicable Laws: means the laws of the United Arab Emirates.
Eligibility
In ensuring that Users are able to form legally binding contracts, eligibility to use the Website is not granted to whom under the age of 18 years, or the age of legal majority in Your jurisdiction, whichever greater;
If You are registering as a business entity, You shall have the authority to bind that entity to these Terms and Conditions and that You and the business entity will comply with all Applicable Laws and terms governing the use of XPLORE Website;
You have full power and authority to enter into this legally binding agreement and in doing so will not violate any other agreement to which You are party;
You are not currently suspended and have not previously been banned by XPLORE from using the Services;
You are not acting on behalf of a competitor of XPLORE;
You will use XPLORE’s Booking Services only to make legitimate reservations for You or others for whom You are legally authorized to act. Any false or fraudulent reservation is prohibited, and any User who attempts such a reservation may have the Account session terminated;
You will use the XPLORE Website in accordance with these Terms and Conditions;
All information supplied by You in the course of Your use of the Services is true, accurate, current and complete.
Accounts and Use and Registration
To benefit from the Services, You shall provide XPLORE all required information in order to create Your Account use the Website and allow XPLORE to provide You with the Services. Otherwise, You shall navigate the Website as a guest;
The Website may requires ask You to submit to Xplore certain personal data including but not limited to Your full name, email address, preferred currency, mobile phone number, and certain financial data such as the debit card or/and credit card data;
You agree to maintain true and accurate, complete, and up-to-date information in Your Account. You are responsible for all activity that occurs under Your Account, and as such, You agree to always maintain the security of Your Account username and password, unless otherwise permitted by XPLORE in writing;

You agree that You are solely responsible for all activities (including Bookings) that occur in connection with XPLORE Account.
You shall notify us immediately of any unauthorized use of Your Account.
We may terminate or suspend Your Account or ability to use the Services if You misuse the Website or terminate or suspend access to Your Account or Your ability to use the Services, in whole or in part, at our sole discretion, and without notice or liability of any kind;
If XPLORE suspects, at its sole discretion, that any of the information You provided is untrue, inaccurate, incomplete, or not current, without prejudice to any other rights and remedies of XPLORE under these Terms and Conditions or under the Applicable Laws, we have the right to suspend or limit Your access to the Website and its Services;
XPLORE may (in its sole discretion and at any time), make any inquiries it considers necessary (whether directly or through a third party), and request that You provide a response with further information or documentation, including without limitation to verify Your identity and/or ownership of Your financial instruments. Without limiting the foregoing, if You are a business entity or registered on behalf of a business entity such information or documentation may include Your trade license, other incorporation documents, and/or documentation showing any person’s authority to act on Your behalf. You agree to provide any information and/or documentation to XPLORE upon such requests. You acknowledge and agree that if You do not, XPLORE without liability may limit, suspend or withdraw Your access to the Website. We also reserve the right to cancel unconfirmed/unverified accounts or accounts that have been inactive for a long time;
Use of the Booking Services
Subject to the User’s compliance with these Terms and Conditions, XPLORE grants the User a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to:
– Access and use the Services solely in connection with the provision of the Services.
– Access and use any content, information, and related materials that may be made available through the Services.
Any rights not expressly granted herein are reserved by XPLORE and may be revoked at any time without notice to the User.
Your use of the Services is permitted by XPLORE only for personal, non- commercial use and/or to make legitimate requests to make a Booking of the Services offered. You agree not to use these Services to make any speculative, false or fraudulent requests or Bookings.
The User shall not use any trademark or any intellectual property rights belonging to XPLORE from any part of the Services, and shall not reproduce, modify, prepare, publicly, perform, transmit, stream, broadcast, or otherwise exploit the Services except as expressly permitted by XPLORE in writing, and shall not decompile, reverse engineer or disassemble the Services, and shall not link to mirror or frame any portion of the Services or launch any programs or scripts for the purpose of scraping, indexing, surveying or otherwise data mining any portion of the Services, or unduly burdening, or hindering the operation and/or functionality of any aspect of the Services or attempt to gain unauthorized access to or impair any aspect of the Services or its related systems or networks.
The User may not post in anywhere else on the site (as determined at our sole discretion): solicitation, advertising, foul language, profanities, obscenities, culturally offensive material, religiously offensive material, critical political content, material that may threaten the public interest or national security, defamatory or libelous harassment, or other content that may be offensive or indecent.

Services
XPLORE Services are represented by serving as a link between the Users who wishes to look for tours and the agencies/tour operators who offer and provide such Services. XPLORE enables Users to search for, select and book travel reservations through the Website. XPLORE enables Users to post opinions of those reservations and engage in interactive travel forums. However, We are not a travel or tour agency, and We do not provide such reservations ourselves. When You make a Booking, You will be purchasing a tour, ticket or other service directly from the Third-Party Service Provider.
XPLORE provides the Website through which You can Book with Third-Party Service Provider. Any service You Book will be exclusively and directly between You and the Third-Party Service Provider. When You buy a Service or make a Booking on the Website, You are not buying anything from Us, but directly from the Third-Party Service Provider.
If You make a Booking, You agree to review and be bound by the applicable Third-Party Service Provider’s terms and conditions and any other rules or policies related to the service. Notwithstanding the foregoing, to the extent that the Service Provider terms conflict with these Terms in respect of Your legal relationship with XPLORE, these Terms and Conditions shall prevail.
Your interactions with the Service Providers are at Your own risk.
XPLORE will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches or negligence of any Service Provider or for any personal injuries, death, property damage, or other damages or expenses resulting from Your interactions with any Third-Party Service Provider.
XPLORE is not a travel agency and does not provide or own transportation services, accommodations, restaurants, tours, activities and experiences. Although XPLORE provides the Website with information about Services and facilities owned by the Third-Party Service Providers, such actions do not in any way constitute XPLORE ‘s sponsorship or approval of such Service Providers, or any affiliation between XPLORE and any Third-Party Service Provider. Although XPLORE Users may rate and review particular Services based on their own experiences, XPLORE does not endorse or recommend any Services of any Service Provider. You agree that XPLORE is not responsible for the accuracy or completeness of information it obtains from Third-Party Service Provider and/or that is displayed on the Website.
XPLORE may, from time to time, change, update or discontinue certain features of the Services. We also offer other services that may be governed by additional terms or agreements. If You use any other such services, the additional terms will be made available and will become part of this Agreement, except where such additional terms expressly exclude or otherwise supersede this Agreement.
Passport and Visas
When You make a Booking, You are responsible for ensuring that You meet all foreign entry requirements and that Your travel documents, including passports and visas, are in order.
For applicable passport and visa requirements, You should consult the relevant embassy or consulate for information. Such requirements may change at any time, and it is Your responsibility to check for up-to-date information before making a Booking and before Your departure. XPLORE shall not bear no liability in connection with any person who is refused entry onto a flight or into any country, including countries such person may just be passing through en-route to their destination
As visa and health requirements are subject to change without notice, XPLORE recommends that You verify health and visa requirements with the appropriate consulate prior to departure. It is also Your responsibility to consult Your physician for current recommendations on inoculations before You travel internationally, and to ensure that You meet all health entry requirements and follow all medical guidance related to Your trip.
Payment
XPLORE provides online payment through debit cards/credit cards as the payment method on the Website.
XPLORE reserves the right to alter, change, modify, or provide any payment method.
XPLORE may provide the online payment services through Third-Party Service Providers.
The User shall ensure sufficient coverage of the respective account that cover the reservations and shall abide by the credit card transaction limits.
When You make a reservation on XPLORE, You must acknowledge that we collect and transfer the amount to the Third-Party Service Provider to complete the transaction, as indicated in our Terms and Conditions.
The value of Your Booking may be subject to taxes, duties, foreign transaction, currency exchange or any other fees. Your bank or payment card company may convert the payment into the local currency and may charge fees, resulting in differences between the amount displayed through the Website, and the final amount charged to You. XPLORE recommends that You contact Your bank or card company if You have any questions concerning any applicable currency conversion or fees.
Pricing
The price of each Service will be quoted on a per-person basis, unless otherwise specified.
Price quotations are subject to change without notice, until a Booking has been made.
Unless the Third-Party Service Provider has otherwise specified, prices do not include any local taxes or use-fees, including foreign departure, security, port charges, customs, immigration, passenger-facility charges or international transportation tax.
Inclusions are determined by the Service Provider. Prices do not include tips/gratuities; passport and visa fees; baggage and personal insurance; any items of a personal nature; taxes or duties; and any beverages or food that the Third-Party Service Provider has not specifically stated are included.
Currency Conversions
If XPLORE provides a currency converter, currency rates are based on various publicly available sources and should be used as guidelines only. Rates are not verified, and actual rates may vary. Currency quotes may not be updates daily, and XPLORE and its affiliates do not warrant or guarantee accuracy.
Electronic Communications
By using Xplore’s Website, You agree that You are communicating with us electronically. Therefore, You consent to receive periodic communications from us. XPLORE will communicate with You via e-mail or may send You information via text messages (SMS), as well as by posting notices on the Website as part of the normal business operation of Your use of the Services. You acknowledge that opting out of any of the means of communication may affect Your use of the Services.
You agree that all agreements, notices, disclosures, and other communications that We provide to You electronically satisfy any legal requirement that such communications be in writing.
XPLORE will request Your consent during the registration process to send You promotional emails or notifications related to the Website and its Services. If at any time, You decide that You do not wish to receive promotional emails, You can opt-out of receiving such promotional emails by clicking on the link at the bottom of any promotional email.
Cancellations and Refunds Policy
Unless indicated otherwise in the Terms and Conditions that apply to a particular Service, once You have made a purchase, You are unable to modify or cancel your Booking and receive a refund.
If the Tour/Experience does not have a specific start time, the deadline to request a change or to cancel will typically be 11:59pm, thirty days before the start date.
If there are a specific time to start the tour/experience, You may request a change to and/or cancel a Booking up to 30 days before the start time of the tour. Timings are determined based on the time zone of Your experience.
You agree on the following in case You wanted to change or amend a Booking:
(b) if a change request can be carried out, XPLORE will not charge an extra fee for doing so as long as the request is submitted within thirty days before the tour or experience starts
(c) Please be aware that the Third-Party Service Provider might demand a fee to accommodate a change request; in such a case, You would be responsible for paying the money so that XPLORE could complete your change request effectively.
XPLORE will process each change request in accordance with the availability and consent of the Third-Party Service Provider.
XPLORE does not guarantee the success of any change request. in such case, your right to a refund (if any) shall be governed by the cancellation terms of your Booking.
When making a Booking using a promotion code or accepting a discount or special offer price during the checkout process you may invalidate your discount or special-offer price by making a change request after Booking.
No refunds are available once an experience has commenced, or in respect of any product’s package, accommodation, meals or any other services that have started to be utilized.

Limitation of Liability
As a User of the Services, You understand and agree that: (1) neither XPLORE nor its affiliates will have any liability to You or others for any unauthorized Bookings made using Your Account mobileand/or XPLORE Account credentials; and (2) the unauthorized use of Your XPLORE account Website and/or XPLORE account credentials could cause You to incur liability to both XPLORE and other Users.
While accessing or using the Website, You may be exposed to content that is offensive, indecent, inaccurate, objectionable, or otherwise inappropriate. XPLORE does not endorse such content, and cannot vouch for its accuracy. You therefore access and use the Website at Your own risk.
XPLORE shall not be liable to You for indirect, incidental, special, exemplary, punitive, or consequential damages, lost data, or damage to Your bank account, or Your XPLORE account, even if XPLORE has been advised of the possibility of such damages. Indemnification
You agree to defend and indemnify and hold XPLORE, its affiliates, sponsors, partners, directors, officers, agents and employees harmless from and against, and to reimburse XPLORE with respect to, any and all losses, damages, liabilities, claims, judgments, settlements, fines, costs and expenses (including reasonable related expenses, legal fees, costs of investigation) arising out of or relating to Your breach of this Terms & Conditions, along with our Privacy Policy or Your violation of any law or regulation or Your use of the Services use by You or any Service Provider of the same Services.
Force Majeure
We shall not be liable for any delay or failure to perform resulting from causes outside of our reasonable control, including, without limitation, any failure to perform due to unforeseen circumstances or cause beyond our control such as acts of god, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, epidemic or other natural disaster, shortages of transportation facilities, fuel, energy, labor or materials or a failure of public or private telecommunications networks.

Jurisdiction and Applicable Laws
The rights and obligations of the parties pursuant to this Terms & Conditions are governed by and shall be construed in accordance with the laws of the United Arab of Emirates.
You hereby irrevocably submit to the exclusive jurisdiction of the Courts of the United Arab of Emirates for any dispute arising under or relating to this Terms & Conditions and waive Your right to institute legal proceedings in any other jurisdiction. We shall be entitled to institute legal proceedings in connection with any matter arising under these Terms & Conditions in any jurisdiction where You reside, do business, or have assets.
Use of the Services is unauthorized in any jurisdiction that does not gives effect to all provisions of these Terms and Conditions, including without limitation, this clause. The foregoing shall not apply to the extent that applicable law in Your country requires application of another law and/or jurisdiction and this cannot be by contract.
Termination
XPLORE and the Users can terminate the account anytime with immediate effect. Please send an email to hello@xploreonline.co and we will delete Your Account.
Rights and obligations of existing travel reservations are not affected by such a termination.
